That is a fine line and depends on what country or state you are in, typically if people are in public anything goes (as long as it isn't for monetary gain or slander)....
You can however be nice and let them know or ask permission, generally if you are not using it to make a profit you don't have to worry, however it gets fuzzy when you are going to use their likeness to make a profit. Again though once in public we are all usually fair game...
Basically look at it this way:
Personal or News use...No release
Marketing/Ads/Profit....Need a release
